Partner. Aside from the services associated with the CSS partnership provided to our

partners – online stores, our website (the “Website”) also offers price comparison for

products of our affiliate or CSS partners (partners are referred to as the “Online Store”). In

these terms and conditions, you are referred to as visitors.


We operate Winnero as Winner.Shopping s.r.o., ID No.: 090 95 837, with its

registered office at Sokolovská 81/55, Karlín, 186 00 - Praha, entered in the

commercial register maintained by the Municipal Court in Prague, File No. C 330849.

Since we are providers of online intermediary services under the European legal regulations,

we have the statutory obligation to provide you with certain information concerning our



Do you need to register?

You do not need to register to use our price comparison function.


How does our price comparison work?

Our visitors can use the comparison function free of charge.


We place offers of individual products (either goods or services) from Online Stores (either

affiliate partners or CSS partners) on our Website. The offers refer to a specific product

offered by the Online Store. Such an offer is available on a website other than our Website –

after clicking on the desired product, you will be redirected to the relevant Online Store. We

do not participate in any offer or potential order of the Online Store’s product in any other

way (than by displaying the product on our Website).


For each offer, we indicate:

· the name of the product;

· the name of the Online Store;

· a photo of the product;

· the product specification;

· the price of the product and shipping information.

The relevant Online Store is liable for any deviation from the final offer indicated by the

Online Store or the product received, and we do not bear any such liability.

The relevant Online Store is further obliged to provide you with information on the products

and your rights.

We receive a commission for your purchase on the Online Store via our Website.


Rules for Product Listing in Price Comparison


We offer you price comparison for the Online Stores’ products displayed on our Website.


The primary parameters that determine the order of the listed products are:

1. the affiliate partnership,

2. the CSS Partnership.

The products displayed in the top positions are those of our affiliate partners. The products

of CSS partners are displayed with lower priority.


The Online Store may influence the listing order. If you are a CSS partner and wish to level

up, you need to become our affiliate partner. We will then add affiliate measuring to each

Furthermore, the visitors may sort the products according to their preferences:

1. descending from the highest price;

3. ascending from the lowest price;


4. by their name.


The Website also has two listing options:

1. listing in the products category;

2. listing in the product details.

Our listing does not automatically take into account the properties of the products or their

relevance to the consumer (only if the visitor uses the option of sorting the results).


Affiliate Cooperation


As a part of our affiliate partnership, we include our affiliate partners in our price

comparison function. If you are our affiliate partner, we assume you agree with the above.


Currently, we or our partners are involved with the following Affiliate networks:

How do complaints and withdrawals from the agreement work?

If you wish to submit a complaint or withdraw from the agreement, you need to contact the

relevant Online Store where you purchased the product to which the complaint or

withdrawal is related.


Because of their nature (in particular, as services free of charge), you cannot submit a

complaint or withdraw from an agreement with respect to our services.


Our Liability


We are obliged to duly indicate the Online Store selling each product.


The Online Store offering such products is liable for all other matters. You should contact the

Online Store if you believe that:

· the product or the information concerning the product is contrary to legal

regulations or good morals;

· the product or the information concerning the product does not correspond to the

information indicated by the Online Store;

· you have been provided with incomplete information;

· your product has not been duly provided, shipped, delivered, etc.;

· your product was delivered later than promised by the relevant Online Store/product


· your rights concerning the product have been infringed;

· your personal data has been mishandled.

Therefore, before each purchase, you should always check the information on the web

pages of the Online Store to which you have been redirected.


All products that are offered are subject to conditions set by third parties, and we are not

liable for their fulfilment.

At the same time, please note that as the providers of information society services, we are

not liable for the content displayed on our Website. This does not apply in the event of our

being notified of the unlawful nature of the content by authorised entities, and we shall

remove such content without undue delay. However, this obligation shall be without

prejudice to our right to temporarily or permanently remove any content displayed on our

Website if we suspect the content to be unlawful, or we may refuse to publish such content

at our sole discretion.


How is our price comparison to be used correctly?


You may not reverse engineer or decompile any part of our Website or circumvent its

technical security measures.

The Website may not be used for purposes other than those indicated by us (i.e. the display

of products and price comparison), in particular, for any unlawful or competitive purposes. If


you use the Website to gain a competitive advantage (for example, by using the unique

principles on which Winner.Shopping is based), you violate our copyrights and these terms

and conditions, and it may also be considered unfair competition.

Unless we give you our consent in writing, you may not access our Website through any

automated tools (e.g. use bots, software or other tools designed for such a purpose).

We also prohibit any interference with the regular operation of the Website, including any

attacks, changes in TCP/IP protocols or intentional transfer of excessive amounts of data that

may overburden our infrastructure.

The spreading of any computer viruses or any other illegal conduct is prohibited.

Our Website, services as a whole and all parts thereof are protected by copyright. You may

not use any part thereof without our consent.


Service Outages


Our Website may be temporarily unavailable as a result of software maintenance or internet

outages caused by technical failures on our part or on the part of third parties. However,

such cases are exceptional, and we do not refund the price paid on the grounds of such

outages. We shall always do our best to ensure 100% functionality and availability of the



Changes in Terms and Conditions


We may unilaterally change these terms and conditions to a reasonable extent, in particular,

as a result of statutory or technological requirements or as a result of expansion or changes

in our services. Should such a change of the terms and conditions affect our CSS partners, we

shall duly inform them thereof in accordance with our terms and conditions for partnership.


Consumer Information


Under consumer law, you have the right to an out-of-court settlement of consumer disputes

arising from the use of our Website. In such a case, you can contact the Czech Trade

Inspection Authority (Central Inspectorate – ADR Department, Štěpánská 15, 120 00 Prague

2, email: [email protected], website: adr.coi.cz). Out-of-court settlement of a consumer dispute is

initiated only on the basis of your request, and in the event of our failure to resolve the


dispute directly. You can submit a complaint no later than one year from the date on which

you first exercise the disputed right. You can also resolve a dispute online through the ODR

platform available here.


You can resolve your disputes with individual Online Stores in a similar manner.
